1. Introduction
These Terms and Conditions (“Terms”) govern your use of the services provided by Anne Marie Sawula, Registered Dietitian (“we,” “us,” or “our”). By booking or using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use our services.
2. Services Provided
We provide nutrition counseling and dietetic services within the scope of practice regulated by the College of Dietitians of Ontario. Our services are educational and supportive in nature and do not replace medical diagnosis or treatment by a physician or other regulated healthcare professional.
3. Client Responsibilities
You agree to provide accurate, complete, and current health information necessary for the delivery of safe and effective dietetic services. You acknowledge that withholding information may adversely affect your care.
4. Appointment Booking, Cancellations, and No-Shows
Appointments must be booked through our online system or by direct contact. All bookings require a valid payment method to hold your spot.
Cancellations or rescheduling requests must be made at least 48 hours prior to your scheduled appointment time. Failure to provide such notice, or missed appointments without notice (“no-shows”), will result in a cancellation fee of $75 or the full session fee, as applicable.
We reserve the right to waive fees in exceptional circumstances at our sole discretion.
5. Fees and Payment
All fees are payable at the time of booking unless otherwise agreed. We accept payment via credit/debit card, e-transfer, or other methods as specified.
Failure to pay fees promptly may result in suspension or termination of services. Outstanding balances may be referred to a collection agency, and you will be responsible for any additional costs incurred.
6. Confidentiality and Privacy
Your personal and health information is collected, used, and disclosed in accordance with the Personal Health Information Protection Act, 2004 (PHIPA). We maintain strict confidentiality of your information, except where disclosure is required by law or permitted for the purposes of treatment, payment, or healthcare operations.
Our privacy practices are outlined in our separate Privacy Policy, which forms part of these Terms.
7. Limitation of Liability
To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to the use of our services, including any errors, omissions, or outcomes related to dietary advice provided.
Your sole remedy for dissatisfaction with our services is limited to a refund of fees paid for the specific service, at our discretion.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario. You agree to submit to the exclusive jurisdiction of the courts of Ontario for any disputes arising out of these Terms or the services provided.
Privacy Policy
1. Collection of Information
We collect personal health information and contact details necessary for the provision of dietetic services. Collection is conducted with your informed consent and in compliance with PHIPA.
2. Use and Disclosure
Your information is used solely for the purpose of delivering dietetic care, billing, and communicating with you. We will not disclose your information to third parties without your consent unless required by law or as needed to facilitate services (e.g., payment processors).
3. Storage and Security
We employ administrative, physical, and technical safeguards to protect your information against unauthorized access, use, or disclosure.
4. Access and Correction
You have the right to access your personal health information and request corrections, in accordance with PHIPA.
5. Retention
Personal health information is retained as required by regulatory standards and securely destroyed when no longer needed.
Cancellation & Refund Policy
1. Cancellations
Clients must provide at least 48 hours’ notice to cancel or reschedule appointments. Late cancellations or no-shows will incur a fee of $75 or full session fee, respectively.
2. Refunds
Refunds are only issued at our discretion and in cases where the service was not provided as agreed. Dissatisfaction with service outcomes is not grounds for refunds.
Social Media and Online Communications Policy
We maintain professional boundaries in all communications, including on social media. Please refrain from sharing personal health information on public platforms. All online engagement complies with the College of Dietitians of Ontario’s guidelines on privacy and professional conduct.
